Actor Cuba Gooding Jr., best known for his Oscar-winning turn in Jerry Maguire, was taken into custody after an alleged altercation with a New Orleans female bartender early Tuesday morning. The star turned himself in and the bartender’s name hasn’t been released.

Says one eye-witness: “He was getting aggravated and rowdy when people were trying to take photos. The bartender tried to calm him down, at which time he pushed her, and before he left the bar he pushed her again.”

The bartender says she told Gooding that police were on their way, and that he should go.  After the actor left, either she or her boss called the police.

New Orleans police issued an arrest warrant for Cuba Gooding, Jr. for municipal battery. But the star met peacefully with police on Wednesday to resolve the matter. “He received a summons to appear in court on Friday at 8.30am at Orleans Parish Municipal Court. At that time, he’ll put in his plea.” Said Frank B. Robertson, lll of the New Orleans Police Department.

Cuba’s rep also confirmed his client has taken steps to resolve the situation. “There is

[now] no warrant. Mr. Gooding, his representative and the New Orleans authorities are moving swiftly to resolve this misunderstanding,”

Cuba Gooding Jr. is in New Orleans to work on the new Lee Daniels movie, The Butler, which also stars Forest Whitaker, Oprah Winfrey and Jane Fonda. The unnamed bartender works at The Old Absinthe House on Bourbon St. in the French Quarter.
