Back in March, a Santa Clarita couple were arrested in their Canyon Country home after deputies conducting a probation sweep discovered over 70 marijuana plants growing on the premises.

After being held in police custody for 5 days, the couple was released after prosecutors decided not to charge them with marijuana cultivation.

Probation sweeps are described by law enforcement as routine operations designed to ensure that those who have recently been released from jail or are on parole are complying with the terms of their release.

The sweep that the Santa Clarita Sheriff’s Station deputies conducted in March netted a total of 9 arrests, including the Canyon Country couple.

Marijuana cultivation falls under California Health and Safety Code 11358 HS, and is described as planting, cultivating, harvesting, drying or processing any amount of marijuana or part of the marijuana plant.

In the State of California, violating 11358 HS is a felony offense, with possible penalties ranging from 16 months to 3 years in jail if you have no prior marijuana cultivation convictions. However, if the person being charged is a non-violent first or second-time offender, or the marijuana was deemed for personal use only, it’s possible to be sentenced to a drug treatment center in lieu of jail time.

Oddly enough, last month, the Canyon Country couple were the victims of a home-invasion style robbery in which the robbers posed as police officers, brandished fake badges, and robbed the home. According to reports, the couple were handcuffed and detained at gunpoint while the robbers searched the house and stole cell phones “and probably a few other items.”
